1. Acceptance of Terms
By accessing, browsing, or purchasing products from I-safe Laser Goggles (referred to herein as “I-safe,” “we,” “us,” or “our”), you agree to be bound by these strict Terms and Conditions (the “Terms”) and all applicable laws and regulations. If you disagree with any part of the Terms, you are expressly prohibited from using this site or purchasing any products.
2. Product Use, Limitation of Liability, and Warranty Disclaimer
2.1 Product Suitability and Certification
- Customer Responsibility: The customer bears sole and absolute responsibility for selecting the correct safety product (goggle type, Optical Density, Wavelength, etc.) appropriate for their specific laser application.
- Certification Reliance: All products are sold based on the certifications provided by the German manufacturer. I-safe provides these specifications in good faith. Any failure or deficiency in certification rests solely with the manufacturer.
- Misuse: The warranty is immediately void if the product is modified, damaged, used outside of its stated specifications, or improperly maintained.
2.2 Limitation of Liability (Strict Clause)
- Maximum Liability: In no event shall I-safe, its directors, employees, or agents be liable for any direct, indirect, punitive, incidental, special, or consequential damages, including but not limited to personal injury, death, loss of sight, property damage, loss of data, or loss of profits, arising out of or connected with the use, performance, or failure of our products.
- Exclusive Remedy: The buyer’s exclusive and sole remedy for any defect or failure is limited strictly to the replacement of the purchased product or, at I-safe’s absolute discretion, a refund of the product purchase price. Under no circumstances will liability exceed the amount paid by the customer for the product in question.
2.3 Disclaimer of Warranties
- AS IS Basis: All products are provided on an “AS IS” and “AS AVAILABLE” basis. I-safe makes no representations or warranties of any kind, express or implied, as to the operation of the site or the information, content, materials, or products included on this site.
- Fitness for Purpose: I-safe expressly disclaims any and all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose (as the final application is beyond our control).
3. Orders, Pricing, and Payment
- Finality of Order: All submitted orders are final and non-cancellable by the customer once payment is processed.
- Pricing Errors: I-safe reserves the absolute right to cancel any order placed at an incorrect price due to a typographical or system error. In such an event, the customer will be notified and issued a full refund.
- International Fees: The customer is solely responsible for all foreign transaction fees, customs duties, taxes, tariffs, and import charges levied by their destination country. These charges are not included in the product price or shipping cost.
4. Shipping, Risk of Loss, and Delivery
- Incoterms: All products are shipped Ex Works (EXW) from our India facility unless otherwise explicitly stated in writing. The risk of loss and title for all products pass to the customer upon I-safe’s delivery to the carrier (e.g., DHL, FedEx).
- Delivery Delays: I-safe is not liable for any delays in delivery caused by the carrier, customs clearance processes, or force majeure events. Delivery dates are estimates only.
- Inspection: The customer must inspect all shipments upon receipt and notify I-safe of any transit damage or shortage within 48 hours of delivery. Failure to do so waives the right to claim damage or shortage.
5. Returns and Refunds (Strict Policy)
- Safety Restriction: Due to the critical, life-safety nature of the product, returns are strictly limited and generally not accepted.
- Eligibility: Returns may only be considered, at I-safe’s sole discretion, for defects in manufacturing materials reported within seven (7) days of delivery. Used, damaged, modified, or improperly selected items will not be accepted.
- Restocking Fee: Any authorized return will be subject to a 25% restocking fee of the product price, plus the cost of original and return shipping, and any associated customs fees.
6. Intellectual Property
- Ownership: All content on this site, including text, graphics, logos, images, and the “I-safe laser goggles” trademark, is the exclusive property of I-safe or its German manufacturing partners and is protected by international copyright and trademark laws.
- Restriction: You are strictly prohibited from reproducing, duplicating, copying, selling, reselling, or exploiting any portion of the service, use of the service, or access to the service without express written permission from I-safe.
7. Governing Law and Dispute Resolution
- Governing Law: These Terms and any separate agreements whereby we provide you products shall be governed by and construed in accordance with the laws of India, specifically the jurisdiction where I-safe is registered, without regard to its conflict of law provisions.
- Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, including the determination of the scope or applicability of this agreement to arbitrate, shall be settled by binding arbitration administered in Mumbai, India, in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in the English language.
8. Changes to Terms
I-safe reserves the right, at its sole discretion, to update, change, or replace any part of these Terms and Conditions by posting updates and changes to our website. It is your sole responsibility to check our website periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
